By accessing or using the ForeverTint platform, you agree to be bound by these Terms of Service. If you do not agree, you must not use the platform. These Terms form a legally binding agreement between you and EN Telemed LLC.
2. Nature of the Platform (No Medical Services)
ForeverTint is not a medical provider or telemedicine company. EN Telemed LLC operates solely as a technology and administrative platform that facilitates connections between users and independent,
licensed medical providers. ForeverTint does not practice medicine, provide diagnoses, offer medical advice, or make determinations regarding eligibility for medical tint exemptions.
3. Independent Medical Providers
All medical providers accessed through the platform are independent contractors and are not employees, agents, or representatives of EN Telemed LLC. Providers are solely responsible for all medical evaluations, decisions, diagnoses, and documentation.
4. No Guarantee of Approval or Outcome
Use of the platform does not guarantee approval of a medical tint exemption or acceptance by any DMV or government agency. All determinations are made solely by the medical provider and applicable authorities.
5. Government & DMV Disclaimer
ForeverTint has no affiliation with any DMV or government agency and makes no guarantees regarding approval, processing times, or enforcement decisions.
6. User Responsibilities
Users agree to provide accurate and truthful information and comply with all applicable laws. Providing false or misleading information may result in denial of service without refund.
7. Payments & No Refund Policy
All fees paid to ForeverTint are for technology and administrative services and are non-refundable, including cases where a provider denies approval or a government agency rejects documentation.
8. No Medical Advice
Content provided on the platform is for informational purposes only and does not constitute medical advice. In emergencies, contact local emergency services immediately.
9. Limitation of Liability
EN Telemed LLC shall not be liable for medical decisions, government actions, or indirect or consequential damages. Any liability shall not exceed the amount paid to ForeverTint.
10. Indemnification
You agree to indemnify and hold harmless EN Telemed LLC from any claims arising from your use of the platform.
11. Intellectual Property
All platform content and technology are owned by or licensed to EN Telemed LLC and may not be used without permission.
12. Termination
ForeverTint reserves the right to suspend or terminate access at any time without refund.
13. Governing Law & Arbitration
These Terms are governed by the laws of the State of California and disputes shall be resolved by binding arbitration.
